Normally individuals who are arrested for DUI spend the night in jail and are released the next morning with a future court date. If you were arrested for DUI, one of the most important things to remember is that California DMV only gives you 10 calendar days from the date of your arrest to request a stay and a hearing to defend your right to drive. This is a separate process from any criminal charges. However, our offices handle both the administrative and criminal aspects of DUI's as part of our service.
If you miss the date for setting that hearing, you’re probably not going to be able to get your license back in any sort of timely fashion. The 10 days include weekends, so it is important to get in touch with an attorney as soon as possible after your DUI arrest.
